These general terms may be updated or modified at any time by the company Bellhouse di Cavalletto Daniela snc, which shall provide notice using the dedicated client communication channels. The consumer undertakes and is obliged, each time changes are made to these general terms, to print and file said terms.

OBJECT OF ONLINE CONTRACT AND ITS DEFINITION

An “online” purchase contract implies a distance contract, that is a legal transaction concerning movable goods and/or services stipulated between a supplier, Bellhouse di Cavalletto Daniela snc, with registered office in Polverara (PD) - Via San Fidenzio, 39/2, and a consumer and/or client within the framework of a distance selling system, which, for said contract, employs exclusively remote communication technology known as “internet”. Therefore, all contracts shall be directly finalised by way of access by the consumer and/or client to the website corresponding to the address www.bellhouse.shop where, by following the indicated procedures, a contract for the purchase of a good/s shall be finalised. Bellhouse may, at its discretion, ask the consumer and/or client for confirmation of the order placed. For distance contracts with consumers, reference is explicitly made to the legislation laid down by section II of Legislative Decree no. 206 of 6th September 2005.

 

ORDERS

Orders are accepted exclusively via the Internet (online). This applies to both standard and customised products.

After completing the online purchase process, the consumer and/or customer undertakes to print and keep these general terms and conditions, which he/she has also already read and accepted as part of obligatory steps prior to the purchase, as well as the specific details of the product that is the subject of the purchase. This is to ensure full compliance with the conditions set out in Articles 4, 5, 52 and 53 of Legislative Decree no. 206/2005.
By filling in the data sheet as part of the registration process required to activate the process for the execution of this contract for your benefit and for further communication, the consumer and/or customer authorises BellHouse to disclose non-sensitive personal data (address, telephone) to the courier services and/or shipping companies they trust, which are commissioned to deliver the purchased goods in order to enable delivery.
 

CONSIGNMENT AND DELIVERY

Delivery times vary depending on the type and availability of products:

  • - STANDARD PRODUCTS:

    generally within 2/3 working days from the date payment is received.
  • CUSTOMISED PRODUCTS:

    delivery times are agreed upon with the client depending on the type of works involved.
    If delivery times cannot be respected, we will contact you immediately
    At the time of the purchase, the client undertakes to track the delivery until the product is received; if the product fails to arrive within a reasonably short period, the client must contact us.

N.B. INVOICE ISSUING

 Pursuant to art. 22 of Presidential Decree 633/72, for e-commerce it is not mandatory to issue a tax invoice if said invoice is requested subsequent to the purchase transaction.
For purchases made without an express request for invoice before the finalisation of the purchase process, transactions shall be registered for tax purposes by payment in accordance with regulations in force, therefore it will not be possible to request an invoice at a later stage.
Therefore, if an invoice is required, the Client is kindly asked to request the invoice at the time of the purchase by ticking the relative box and filling in the necessary information.

PRODUCT AVAILABILITY
The items for sale may be temporarily unavailable, in which case Clients shall be informed via email, or if possible, via phone. Should the ordered item not be available within the time frames agreed upon with the client, we avail ourselves of the right to agree on a replacement product with the client, having equivalent characteristics, or alternatively cancel the request and refund any amounts paid.
In the event of discrepancies between the characteristics reported and those encountered in the purchased product/s, we kindly ask you to inform us within 7 days of receiving the product/s in order to activate return procedures and arrange for the immediate refund of any amounts paid, allowing us in turn to submit any necessary claims to the courier. Our company highly values the complete and unconditional satisfaction of our clients, and for this reason, we also need your collaboration. 

RISK AND PROPERTY

To this end, it is noted that all parcels are packaged with cardboard, plastic film and adhesive tape.
The images of products published on our website are purely indicative, in good faith and non-binding; Bellhouse reserves the right to apply changes and structural improvements without any prior notice. In the absence of specific instructions in the order notes, the lack of conformity of the purchase cannot be denounced.

At the time of delivery of the goods, the client is obliged to:
• Print the email with the tracking code,
• check that the number of parcels delivered coincides with the number indicated in the delivery document, insofar as in the event of multiple parcels, the goods may be delivered in separate consignments on different days,
• check that the packaging is intact and has not been tampered with, including the sealing tape. In the case of tampering and/or breakage, the client must immediately contest the consignment and/or delivery, writing - GOODS ACCEPTED WITH RESERVE - on the delivery note received from the courier, and (very important) check that the courier approves and confirms the signature of acceptance with reserve.

Even if the packaging is intact, the goods must be checked within seven days of their delivery. Any hidden defects must be notified in writing via fax, registered post with return receipt or via certified email. Any notifications received beyond the aforesaid terms shall not be taken into account. For each declaration, the client assumes full responsibility for that declared.
IN CASE OF MATERIALS DAMAGED DURING TRANSPORT:

  • - It is important for goods to be checked at the time of their delivery in the presence of the courier. If defects in the parcel are found such as tears or dents, please return the parcel to the sender and we will arrange for a new one to be sent.
  • - It is important to accept the goods with reserve on the letter issued to you by the courier and signed by the same, in the case of damaged materials accepted by you exclusively with reserve and signed by the courier, the cost of returning products to our facilities shall be at your expense, we do not collect products.
    CLAIMS SHALL NOT BE ACCEPTED IF ‘ACCEPTED WITH RESERVE’ IS NOT WRITTEN ON THE DELIVERY LETTER ISSUED BY THE COURIER AT THE TIME OF RECEIVING THE GOODS.

RIGHT OF WITHDRAWAL

Pursuant to article 3 of Legislative Decree 196/2003 regarding consumer protection in the case of distance contracts, if the Client, for any reason whatsoever, is not satisfied with the purchase made, he/she has the right to withdraw from the sale contract without any penalty fees and without specifying the reason within 10 working days from the day the Products are received. The right of withdrawal must be exercised by way of written communication via certified email (address ...), sent within the aforesaid terms under penalty of forfeiture, explaining the desire to withdraw from the finalised contract. Should the Client exercise the right of withdrawal, he/she shall also bear the costs of returning the INTEGRAL and NON-USED goods (in their original packaging). Goods shall be returned within and no later than 10 working days, insured and carriage paid to the Vendor’s facilities. Under no circumstances shall parcels delivered using cash on delivery or freight collect modes be accepted. The right to withdraw shall lapse in its entirety in the event the “essential condition of the integrity of the goods” (packaging and/or its contents) is not satisfied, in cases where the company Bellhouse ascertains: the absence of original external/internal packaging; the absence of integral elements of the product (accessories, screws, manuals, other parts, ...); use of the product such that it is impossible to restore the pre-existing conditions prior to the sale.
Should the right of withdrawal be exercised in accordance with these instructions, the Vendor shall refund the amounts paid by you to purchase the goods (excluding costs relative to returning the goods, which shall remain at the expense of the Client or the specific cases described below), within 30 days.
